Terms of Use
Mailbox Service Agreement
Our Mailbox Service Agreement ("Agreement") is made and entered into by the customer identified as the ("Customer") for the use of and services related to a mailbox ("The Mailbox") at Executive Business Services under the terms and conditions set forth herein:
Customer agrees that they will not use EBS premises or any EBS services for any unlawful, illegitimate or fraudulent purpose.
Payment
Cash is accepted for all amounts. Credit card payments are accepted for transactions over US$10.00 (AMEX excluded).
Mailbox Fees and Service Charges
Mailbox Renewals/Service fees are due and payable in advance. Customer agrees that EBS may hold mail and packages pending payment. Mailbox service fees and other related fees stated herein are subject to change. In the event that Customer receives extremely large packages, EBS may require Customer to pay additional charges. EBS reserves the right to increase the Mailbox service fees if the Customer adds additional individuals or entities to the names of those individuals or entities authorized to receive mail and packages at EBS.
Subscriber Limit
Each Mailbox is allotted a maximum of TWO (2) subscribers.
Freight Services
EBS receives both Air and Ocean freight cargo. Airfreight is charged based on volume, if it is greater than the weight. Ocean freight is charged by weight only.
Package Consolidation
EBS offers package consolidation as part of its mailbox service, whereby multiple packages may be combined into a single shipment at the Customer’s request. While EBS takes reasonable care during the consolidation process, EBS shall not be held liable for any damage that occurs as a result of repackaging or consolidation. It is the Customer’s responsibility to ensure that items intended for consolidation are suitable for combined shipping. Consolidation fees, where applicable, will be communicated to the Customer prior to processing.
Prohibited and Restricted Items
Customer agrees not to ship any items that are prohibited, restricted, or regulated under applicable laws, including but not limited to: hazardous materials, flammable substances, firearms and ammunition, perishable goods, live animals, illegal substances, or any items restricted by US export regulations or Sint Maarten import laws. EBS reserves the right to refuse, hold, or dispose of any shipment believed to contain prohibited or restricted items. EBS shall not be liable for any loss, delay, or costs arising from a Customer’s failure to comply with this clause. Any fines, penalties, or costs incurred by EBS as a result of a Customer shipping prohibited items will be charged to the Customer’s account.
Customer Restrictions
Customer is not allowed:

To Sublet the Mailbox

To allow another person to use their Mailbox with “In Care Of”

To give the mailbox address to non-registered mailbox users.

Customers will be charged an unauthorized user fee of US$15 for any unregistered persons who receive mail through their mailbox.
Service Fees
A fee of US$5 will be charged to a customer’s account in the event any of the following is requested of EBS:

To track packages

To make amendments to a Customer’s shipping method (i.e., Air to Ocean or vice versa).

Placing shipments on hold in Miami or return to sender.
Mail and Package Receipt
As Customer’s authorized agent for receipt of mail, EBS will accept all mail, including registered, insured and certified items. Customer must accept and sign for all mail and packages upon receipt. Customers who receive “oversized” packages at EBS will be notified for immediate pick up since there is limited space. Packages not picked up within three (3) days of notification will be subject to a storage fee of US$10.00 per day, which must be paid before Customer receives the package.
Unclaimed Packages
Packages not retrieved by the Customer within thirty (30) days of notification will be considered abandoned. EBS reserves the right to dispose of, donate, or destroy any abandoned packages without further notice to the Customer. EBS shall bear no liability for any loss arising from the disposal of abandoned packages. Storage fees as outlined in this Agreement continue to accrue on oversized packages during this period.
Customer Notification and Contact Information
EBS will communicate with Customers using the contact information provided at the time of registration. It is the Customer’s sole responsibility to ensure that their contact details — including email address and phone number — are kept current with EBS at all times. Official notifications from EBS, including package arrival notices and account alerts, will be delivered via email and/or WhatsApp. EBS shall not be held responsible for any missed notifications resulting from outdated or incorrect contact information on file.
Liability
CUSTOMER HEREIN AGREES THAT THE TOTAL AMOUNT OF LIABILITY OF EBS, IF ANY, FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED US$100.00 REGARDLESS OF THE NATURE OF THE CLAIM.
Insurance
Customers have the option to purchase insurance on items shipped through EBS that exceed a value of $100.00. The Customer must notify EBS of their desire to insure their item, in writing, at least 5 days prior to the item’s delivery to the EBS Miami office. This written notice must include an invoice, receipt or other document detailing the nature and value of the item that is to be insured. The cost of the insurance is 1.1% of the value of the shipped item(s) and is entirely at the expense of the Customer. In case of damage, loss or theft of the insured item, a claim will be filed with the Insurer on behalf of the Customer.
Termination of Agreement
All mailbox services between EBS and the Customer will be terminated if the customer does not pay the Mailbox renewal within one (1) Month after expiration date.
Customer agrees that EBS may terminate or cancel this Agreement for good cause at any time providing customer thirty (30) days written notice. Good cause shall include but is not limited to:

Customer uses the Mailbox for unlawful, illegitimate or fraudulent purposes.

Customer fails to pay monies owed to EBS when due.

Customer engages in offensive, abusive or disruptive behavior towards other customers of EBS or EBS’s employees.

Customer violates any provision of this agreement.
Customer acknowledges that for the purpose of determining good cause for termination of this Agreement, as provided herein, the actions of any person authorized by Customer to use the Mailbox will be attributed to Customer. Once the Agreement has expired or been cancelled or terminated EBS may:

Refuse any mail or packages addressed to the customer and delivered to EBS.

Discard or destroy any of Customer’s mail or packages delivered or remaining at EBS at such time.
Mailing Address Requirements
Customer must use the exact mailing address for the Mailbox without modification. Any mail addressed incorrectly will be returned to the sender endorsed “Undeliverable as Addressed”. EBS does not take responsibility if the Customer uses the address incorrectly.
Force Majeure
EBS shall not be held liable for any failure or delay in the performance of its obligations under this Agreement where such failure or delay results from circumstances beyond EBS’s reasonable control, including but not limited to: natural disasters, acts of government, customs delays, carrier disruptions, labor disputes, power outages, or any other event of force majeure. EBS will make reasonable efforts to notify affected Customers and resume normal operations as soon as practicable.
Data and Privacy
EBS collects and retains personal information, including valid identification, contact details, and shipping records, for the purpose of providing mailbox and freight forwarding services. This information will not be shared with third parties except where required by law or where necessary to facilitate the Customer’s shipments. By entering into this Agreement, the Customer consents to EBS retaining and using their personal information for the purposes described herein.
Identification and Agreement Modifications
Upon signing this agreement, Customer shall provide a form of valid identification. This agreement may not be amended or modified, except in writing signed by both parties.
Claims and Damage
No “non-visible” claims can be made after packages have left the Mailbox facilities. All packages must be checked for damage before leaving the Mailbox facilities. Claims made by Customers after the package have left the facilities will be deemed invalid and will not be honored by Mailbox.
